This Terms of Service ("Terms") constitutes a legally binding agreement between you ("Customer," "you," or "your") and Brushworks Services Co. ("Brushworks," "we," "us," or "our"), governing your access to and use of Brushworks' services, website, communications, messaging programs, and equipment operations. By requesting a quote, scheduling a service, submitting your information, opting into messages, or otherwise engaging Brushworks, you agree to these Terms in full.
1. Services Covered
These Terms apply to all services provided by Brushworks, including but not limited to:
- Forestry Mulching & Brush Clearing
- Land & Property Reclamation
- Tree Removal, Tree Pruning, Storm Cleanup
- Snow Plowing, Snow Removal, Ice Management
- Equipment-Based Services (including remote-operated machinery)
- Consulting, Estimates, Quotes & Site Evaluations
2. Estimates, Quotes & Payment Terms
- All estimates are based on information available at the time of quoting. Final pricing may adjust based on actual site conditions, including brush density, debris, terrain, or accessibility.
- Quotes are valid for 30 days unless otherwise stated.
- Jobs over $10,000 require a 10% deposit to secure scheduling and equipment allocation.
- Deposits are refundable if cancellation occurs 14+ days before the scheduled start date.
- Deposits are non-refundable if cancellation occurs within 14 days of the start date.
- Payment in full is due immediately upon completion unless otherwise agreed in writing.
- Failure to pay may result in collections, liens, or legal action.
3. Customer Responsibilities
By engaging Brushworks services, you agree that:
- You are the legal property owner or have authorization from the legal owner.
- You grant Brushworks access to the property with heavy machinery.
- You are responsible for disclosing utilities, septic systems, irrigation lines, and other hidden hazards.
- You agree to clearly mark or remove hazards.
Failure to Disclose Utilities or Hazards:
Brushworks is not responsible for any damage resulting from unmarked or undisclosed utilities or obstacles. Repair costs are the responsibility of the property owner.
4. Property & Equipment Liability Disclaimer
- Brushworks operates heavy machinery that may cause ground disturbance.
- Brushworks is not liable for cosmetic or incidental damage to lawns, soil, turf, or vegetation during standard operations.
- Customer assumes responsibility for natural changes in terrain resulting from clearing or grading services.
5. Snow Plowing & Turf Damage Disclaimer
- Snow and ice conceal ground conditions.
- Brushworks is not responsible for turf, sod, gravel, or landscaping damage resulting from snow plowing unless otherwise agreed in writing.
6. Messaging Terms & Conditions
When you opt in to Brushworks messaging, we may send you a message to confirm your signup.
By opting into messages, you agree to receive recurring automated marketing and informational text messages from Brushworks Services Co. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.
Messages may include quote and estimate follow-ups, appointment confirmations, scheduling notices, project updates, service reminders, customer support messages, educational content, seasonal reminders, offers, and promotions.
Message Frequency: Message frequency varies. Additional mobile messages may be sent periodically based on your interaction with Brushworks. Brushworks reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Brushworks also reserves the right to change the short code, phone number, or alphanumeric sender where messages are sent.
Message & Data Rates: Your usual message and data rates may apply. If you have questions about your text plan or data plan, contact your mobile provider.
No Purchase Required: Your consent to receive marketing messages is not a condition of purchase.
Carriers: Carriers and mobile providers are not liable for delayed or undelivered messages.
Cancellation: Messages will provide instructions to unsubscribe either by texting STOP or through an included link. After you unsubscribe, we may send a message confirming that you have been unsubscribed, and no more marketing text messages will be sent unless you sign up again.
Support / Info: For support regarding our services, email us at alex@brushworksco.com or, if supported, text HELP to our messages at any time. If we include a link in messages we send, you may also access unsubscribe instructions and company information by following that link.
Transfer of Number: Before changing your mobile number or transferring your mobile number to another individual, you agree to either reply STOP from the original number, unsubscribe using the link included in our messages if one is provided, or notify us of your old number at alex@brushworksco.com. This duty to inform us is a condition of using the messaging service.
Privacy: If you have questions about your data or our privacy practices, please review our Privacy Policy.
Messaging Terms Changes: We reserve the right to change or terminate our messaging program at any time. We also reserve the right to update these Messaging Terms at any time. Changes are effective immediately upon posting. If you do not agree to a change, you should cancel enrollment in our messaging program. Continued enrollment after changes are posted constitutes acceptance of those changes.
7. Service Limitations & No Warranty
- All services are provided "as-is" with no warranties, unless stated in writing.
- Brushworks does not guarantee results impacted by weather, land conditions, wildlife, or natural regrowth.
8. Weather & Scheduling Delays
- Services may be postponed due to weather or equipment conditions.
- Deposits will not be forfeited if Brushworks initiates rescheduling.
9. Cancellations & Rescheduling
- Cancellations must be submitted in writing to team@brushworksco.com.
- Deposits for projects over $10,000 are refundable if canceled 14+ days prior.
- Smaller jobs may be rescheduled one time at no cost if done 72+ hours in advance.
10. Limitation of Liability
- Brushworks' total liability is limited to the total amount paid for services.
- Brushworks is not liable for indirect, incidental, or punitive damages.
- Customer agrees to indemnify Brushworks for claims arising from undisclosed hazards or property access issues.
11. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Ohio.
- Any disputes will be resolved in the courts of Warren County, Ohio.
12. Changes to Terms
- Brushworks may update these Terms at any time.
- Continued use of our services constitutes acceptance of any updated Terms.
